If bailiffs are involved, Dolina could face a new wave of problems, ranging from fines to criminal charges. Sergey Zhorin, an attorney, explains: “If bailiffs are involved and an enforcement proceeding is initiated, the transfer of keys and a separate ‘act of goodwill’ from Dolina will not be required. Bailiffs have the authority to open the apartment, change the locks, and transfer the property to the owner based on their report. The key point in this entire story is that the transfer of keys is not a mandatory condition if there is a court decision.”
Potential Fines and Charges
Dolina could face fines starting from 1000-2500 rubles, increasing to 5000 rubles if she continues to resist. Repeated non-compliance could lead to a charge of “malicious non-compliance” under Article 315 of the Criminal Code, resulting in a fine of 50,000 rubles or even imprisonment for up to one year.
Why Insist on the Transfer Act?
Despite the possibility of Lurie moving into the apartment without Dolina’s signature, she insists on the transfer act. Sergey Zhorin suggests that Lurie might be giving Dolina “an opportunity to comply with the court’s decision voluntarily” while also gathering evidence against her. The longer Dolina resists, the worse her position becomes.
Financial and Legal Repercussions
Dolina’s financial losses could extend beyond bailiff fines to include compensation for Lurie’s use of the apartment. “If it is established that the apartment was retained without legal grounds, it is possible to recover payment for the use of the residential premises, damages, and sometimes even amounts for unjust enrichment. In a prolonged conflict, we could be talking about quite substantial sums,” notes Zhorin.
He emphasizes that ignoring the court’s and bailiffs’ demands will not lead to a compromise but to the most severe enforcement measures, leaving Dolina with no control or ability to correct the situation.

The saga began in the spring of 2025 when Dolina sold her apartment to Lurie. After losing her home, Dolina shared her emotional turmoil: “Why did I remain silent for so long? Because I was in shock.
